PRESIDENT’S MESSAGE:
Brothers & Sisters: On behalf of myself and the entire Lodge 100 board we wish you a
Safe, Heathy and Happy Thanksgiving.
I am pleased to report the following:
EVP Michelle Schaefer was elected to the position of NYS FOP Recording Secretary.
Immediate Past President Rick Bermudez was re-elected to the position of NYS FOP
Chairman of the Trustees.
I (humbly) was re-elected to the position of NYS FOP Zone VP.

We were elected/ re-elected at the NYSFOP conference in October 2022. It is an honor &
privilege that our Lodge 100 delegates placed their confidence and support in the 3 of us and
were actively campaigning for the Lodge 100 Team, among our peers. The members of 23
other Lodges in attendance at the conference.
Hoping to see you at our Lodge Holiday meeting on December 7, 2022, at 1900 hours.
Please bring an unwrapped child’s toy for our Charity Toy Drive. Our member, Dan Albano is
once again involved in running a holiday food drive. (see attached flier) If you would like to
participate, you may bring donations to our Holiday meeting.
Those that qualified for the Early Bird Renewal will be automatically entered in a drawing
for a $100 prize. Drawing will be held at the December meeting.
Those that have not yet renewed, your benefits cease on 12/31/2023. They are back in
force when the National FOP receives your renewal confirmation.
Save the date for the Lodge 100 Awards Dinner, April 20, 2023 at Russo’s on the Bay.
Past Honorees included Det. Dalsh Veve & Tunnel to Towers Foundation. The 2 were
recently linked once again as the Veve family garage was converted, by T2T into a physical
therapy suite. I like to think that our Lodge’s fundraising efforts contributed to that endeavor.
Once again your Executive Board unanimously voted to dedicate the proceeds of our annual
raffle to the Tunnel 2 Towers Foundation. Let’s all dig and dig deep.
As always, remember our brothers and sisters protecting our streets at home and those
serving in the armed services. Pray for the recovery of those who are suffering illness and
“Never Forget the Fallen, Honor Their Memory” and their surviving families.

Executive Vice President Message:
On this Thanksgiving eve, I would like to wish all of you and your families a very HAPPY
THANKSGIVING!  We here at Lodge 100 have much to be thankful for.  Yesterday, we heard
the Court of Appeals affirmed the lower court's decision and sided with the Retirees on the
Medicare Advantage issue.  The Judges unanimously agreed with Judge Frank's decision
that the City CANNOT charge the retirees to opt out and keep GHI SeniorCare as a
supplement to Medicare.
However, the fight is not over.  The City is now demanding of the City Council to open the
City Charter and change Administrative Code 12-126.  This is the law that states the City
must pay the full cost of our medical care up to the HIP basic rate.  If this is changed, the City
wants to word it to allow them to charge us for our healthcare. Once they open it up to
changes, it is possible they could take away the Medicare reimbursement as well (this has
not been mentioned so far).
The heads of the UFT (Teachers Union) and some other unions are lying to their active
members.  They are telling them to contact their council members and ask to vote to change

the law as they will lose their healthcare if it is not changed.  This couldn't be further from the
truth.  If you know any active employees, please enlighten them.  This law is the ONLY thing
protecting their healthcare.
We are asking all of our Lodge 100 members, to contact your local council member and
ask them NOT to support changing 12-126.  This law has been protecting our healthcare
since the 1960's and the basis of what the Judges in both courts used to rule in the retirees
favor on this Medicare Advantage Plan issue.  If you no longer live in the City (or never have)
contact the council member covering one of the areas where you worked.  Contact any of
them.  Contact several of them.  The more the merrier.  Have your family members and
friends contact them as well.  Call them, email them, and/or write to them!!!  Please keep it
professional when you contact them as we need their support.  
There are approximately 18,000 retirees in the group following this lawsuit out of the
250,000 NYC retirees out there.  If you want to follow them on facebook, search the group
name  NYC Organization of Public Service Retirees (for Benefit Preservation) and join
the group or go to their website at  https://www.nycretirees.org/   As always we will update
you as often as we can with this evolving issue.

ANALYSIS OF NEW YORK STATE’S RECENT AMENDMENTS REGARDING GUN
SAFETY: Attached is a very well written summary of the new extremely restrictive gun legislation
recently enacted by Gov. Hochul which took effect on September 1, 2022. The summary was written
by James Tuttle, Esq., counsel to the Police Conference of New York, and he specifically addresses the
issue of how the legislation “specifically exempts federal law enforcement, state and local police
officers, peace officers, retired police officers and others from many of its most significant provisions.”

FREQUENTLY ASKED QUESTIONS REGARDING RECENT CHANGES TO NEW YORK
STATE FIREARM LAWS: On June 23 rd , 2022, the United States Supreme Court issued a decision
in the case of the New York State Rifle and Pistol Association v. Bruen. The Court ruled that New
York's law requiring a license to carry concealed weapons in public places is unconstitutional. On July
1 st , 2022, Governor Hochul, with the backing and support of the Democrat controlled state Assembly
and Senate, signed legislation bolstering restrictions on concealed carry weapons. Legislation
(S.51001/A.41001) Restricts the Carrying of Concealed Weapons in List of Sensitive Locations -
Institutes a Default of No Concealed Carry on Private Property and Businesses Unless Deemed
Permissible by Property Owners - Establishes New Eligibility Requirements and Expands
Disqualifying Criteria for Those Seeking Concealed Carry Permits - Enhances Safe Storage
Requirements - Extends Requirements to Vehicles - Requires Backgrounds Checks for All
Ammunition Purchases - Amends Body Armor Purchase Ban to Include Hard Body Armor. Click on

GOVERNOR HOCHUL SIGNS LEGISLATION TO MAKE NYPD PENSIONS PUBLIC:
This information is summarized from the NY Daily News article Make Police Pensions Public: Gov.
Hochul Does the Right Thing, Signing an Overdue Transparency Bill, by Daily News Editorial Board,
published on 08/14/2022 - NY Daily News - 8.14.22
On Monday, August 8 th , Governor Hochul signed a simple bill to clarify in state law that the names
of government pensioners are public — that is, the actual “retiree,” not a surviving family member, the
“beneficiary,” who collects the pension when the retiree dies.
So, the salary of Police Officer John Smith is now public, as is his pension when he puts in
retirement papers after 20 years. Should he pass away, and his pension is assigned to his widow, Jane
Smith, her name remains unseen.
This has long been the spirit of the law, but the NYPD’s Police Pension Fund has fought against
disclosure and a series of court errors has complicated the matter for a dozen years as the nonprofit
Empire Center for Public Policy has steadfastly sought to collect the information for its extremely
useful See-Through NY site on how New York’s tax dollars are used.
The new law, which took effect immediately when Hochul signed it. On Tuesday, August 9 th , the
Empire Center submitted a new Freedom of Information Law request for the last five years of pension
payments along with the names of NYPD retirees. The PPF must comply.
This only applies to the NYPD, as pensions for every other public employee in this state, including
all other police departments, have long been public. We value the NYPD greatly, but they don’t get to
have their retirees collect public pensions that the paying public can’t see

ISSUE RELATED TO RETIREES RESIDING IN NYC AND RENEWING PISTOL
PERMIT/LICENSE WITH NYPD LICENSE DIVISION: We have been advised by several of our
retired members that the NYPD License Division, is, in some cases, requiring retired members (living
in NYC & getting license from the NYPD) to attend a 16 hour Gun Safety Course and 2 hour Live
ammo course. This requirement is a result of legislation passed by the New York State Legislature and
signed into law by Governor Hochul. As per the legislation, and as articulated by the NYS Divison of
Criminal Justice Services (DCJS), effective September 1, 2022, retired members of the Department
who retired prior to September 1, 2017, and who receive their pistol permit/license from the NYPD
License Division may now be required to attend a 16-hour state-regulated training course and a 2 hour
live-fire training course as a mandatory step in renewing their pistol permit/license. To reiterate, as of
now, this requirement only applies to those members who retired prior to September 1, 2017.
We have also been informed that those retired members who have been in continuous possession
(unsure what fulfills continuous possession) and currently possess a valid HR 218 may be exempt from
some or all of the training requirements.
The Lieutenants Benevolent Association sent a communication to the Police Commissioner asking
her to please reconsider the NYPD’s interpretation of the requirements stipulated by NYS DCJS and to
exercise the discretion permitted to waive the training requirements for retired law enforcement and
military members based on their prior extensive gun safety and live ammo training.
New York City is the only licensing/issuing municipality requiring this training for some of its
retirees. The surrounding counties of Nassau, Suffolk, Westchester, Putnam, etc are not requiring this
training.

NYC HEALTH INSURANCE OPEN ENROLLMENT PERIOD: We have been advised by the
New York City, Office of Labor Relations, Health Benefits Section that the 2022 Open Enrollment
Period for New York City Employees will be as follows:
The Annual Health Insurance Coverage Transfer Period for Active Members and Retired
Members will be from November 1 st through November 30 th .
During Annual Health Insurance Coverage Transfer Period, Active and Retired members of the
service may transfer from their present health plan into another City health plan, add or drop optional
rider coverage, and add or drop a dependent.

INFORMATION REGARDING THE NYC MEDICARE ADVANTAGE PLUS PLAN (This
information is directly from the NYC Health Benefits website): New York City was notified on July
15, 2022, that Anthem/Empire Blue Cross Blue Shield has withdrawn its participation in the NYC
Medicare Advantage Plus Plan. The City and the Municipal Labor Committee continue to believe that
a customized Medicare Advantage Plan provides the retirees, the City and its taxpayers with the best
opportunity for high quality healthcare. We remain committed to moving forward with the program
and are exploring alternative options.
- All retirees will remain in their current plans until further notice.
- NYC Office of Labor Relations Health Benefits Section will post updates for retirees as they have
more information.

ROOKIE CLUB: Effective April 1, 2021, Members in good standing, who experience the Birth or
New Adoption of a child, will be eligible for a $50 benefit. Proof of birth or adoption must be
provided.

Application. Those members renewing by October 15, 2022, will be included in an early bird drawing

2) If possible, fill out the form on your computer, then print it out, sign it, include your annual dues
payment (please take note of new dues amount) and mail to the Lodge. If you have any changes from
2022 please check the box in the upper right corner. Your renewal application will not be processed if
it does not include your dues payment.
3) Please do not send in a renewal that simply says, “Same as Last Year”. A current completed
application is required for your insurance qualifications.
4) Please provide your email address on your renewal application. Most of our Newsletters are now
sent primarily via e-mail; only two (2) Newsletters per year go out hard copy via the US Mail. This is a
cost savings for the Lodge and reduces the labor-intensive mailing process performed by the

There is no shortage of features on this app – and all are designed to improve
communication and get you information quickly on all things happening within the Order. There is a

take you directly to our one-of-a-kind COVID-19 website, the National current website, and their

There is a messaging feature on the app (much like Facebook Messenger) that allows you to
send text messages within the app to other members in the country who have downloaded it. There is
an events tab loaded and continuously updated with all upcoming FOP conferences, meetings,

PRESIDENT’S MESSAGE: Brothers & Sisters:
On behalf of myself and the Board of Officers I would like to wish you and yours a safe &
healthy Memorial Day. Please remember, it’s not about the BBQ, it’s about “Never Forgetting
the Fallen & Honoring Their Memory”.
Sadly, our elected officials continue to wage war against law enforcement. These
politicians have no clue about the realities affiliated with law enforcement, perpetuate a false
narrative depicting the police as the enemy all the while they coddle criminals. Many of these
same politicians are the architects behind the failed Bail Reform Law which has created a
revolving door of arrested criminals being immediately released back on the street, free to re-
offend. If that isn’t bad enough, in cities across the United States, radical ‘progressive’ District

Attorneys are reluctant and often unwilling to prosecute the growing number of violent
criminals. These DAs, instead, support the Bail Reform Law, emboldening criminals to re-
offend without consequences. For those living in NYC, are you comfortable riding or having a
family member ride the NYC subway, or just walking around your own neighborhood at night?
What can you do about it? Get off your butt and Vote. Low voter turnout has allowed the
‘progressive’ politicians to destroy our society and make our streets unsafe.
On a personal note, I mourn the loss of a friend and mentor, Retired NYPD Lieutenant
Tony Garvey. Tony was a decorated combat veteran having served as a Sgt for an infantry
squad in 1968 with the 9th Infantry Division, during the Vietnam conflict. He served with the
NYPD from June 25th, 1973, until June 30th, 2010. Tony was the longest serving President
of the Lieutenants Benevolent Association, serving in that title from 1991 to 2007. In 2007,
then Police Commissioner Raymond Kelly, appointed Tony to the position of Executive
Director of the Police Pension Fund. It was from this position that Tony retired from the Police
Department after serving for 37 years.
I also want to address the moronic “Diaphragm Law”, while it is primarily geared towards
the NYPD, it applies to any Law Enforcement Officer performing duties within the confines of
NYC. It applies, even if the apprehension was because of crossing into NYC from a
contiguous municipality. This is yet another example of how little the NYC & NYS politicians
support Law Enforcement.
For the many Active members of Lodge 100, you have the potential to be called to the
Career Criminal Revenge Board (CCRB). Please review all available information relating to
the incident in question. That includes your and others’ bodycam footage. CCRB is
attempting to distort the reality of what occurred 2 years ago during the summer of love riots
and domestic terrorism that targeted police officers and businesses during 2020. CCRB, like
certain ‘progressive’ politicians, are attempting with their rose-colored glasses to classify
violent riots as peaceful protests and police officers as the antagonists against a cooperative
and submissive crowd. If you were awake during 2020 you know the reality. This is utterly
disgusting.
I, would like to acknowledge and thank our Lodge Chaplain, Msgr Robert Romano for once
again opening and closing our 2022 Awards Dinner with prayer and levity. I met Msgr
Romano 32 years ago, he has always been available to all needing comfort, counsel, or just
to be a guy to laugh with. Now is the time we return Msgr Romano’s gift to us. A fellow priest
that Msgr Romano was ordained with, FDNY Chaplain, Msgr John Delendick, is suffering
from an illness due to his work during 9/11. He needs your good thoughts and prayers.
Please help.
I wish to congratulate NYPD Lt. Lou Turco and the entire LBA Board on their uncontested
re-election. Many of the current and former LBA board members are also Memorial Lodge
100 members. The mutual support and exchange of ideas has proved beneficial for both
organizations. They are truly the ‘Leaders of the Finest’.
I also wish to congratulate Lodge 100’s own Matty McGeever on his taking the reins of the
New York 10-13 Assoc. as its President. Good Luck and much success. Lodge 100 has your
back.
Lodge 100 has members from many different agencies, if you have information that would be

beneficial to others that isn’t covered by the Lodge newsletters, I invite and welcome your

NEW YORK STATE APPELLATE DIVISION RULING REINSTATES THE NYC
COUNCIL’S “DIAPHRAGM LAW”: Last year the New York City Police unions were
successful in petitioning the New York State Supreme Court to throw out the New York City
Council’s law prohibiting law enforcement officers from applying any pressure on a person’s
torso/chest/diaphragm when attempting to physically control a person or take them into
custody. The City Council’s law made an officer(s) liable to be arrested and charged with a
misdemeanor crime if he/she/they were to put pressure on a person’s torso/chest/diaphragm
when attempting to physically control a person or take them into custody. Most rational
people can see the lunacy of this law, how it places law enforcement and the public I general
at a greater risk of injury, and how such a law advocates for the criminal.
Well, the New York City Council, who seem to frequently pass legislation advocating for
criminals, appealed the NYS Supreme Court decision and on Thursday, May 19 th , the New
York State Appellate Division Ruled that the “Diaphragm Law” can go back into effect. So
now any law enforcement officer that intentionally or unintentionally places pressure on a
person’s chest/torso/diaphragm, even if the person is attempting to seriously injure a police
officer or innocent bystander, is potentially liable to be arrested ad charged with a
misdemeanor offense. THIS LAW IS BACK IN EFFECT NOW.
When this law was initially passed, bordering law enforcement agencies around NYC and
federal law enforcement agencies operating in NYC advised their members to avoid taking
any enforcement/apprehension action within the confines of NYC. If you or someone you
know is a member of law enforcement operating within the confines of NYC, please be
cognizant of this reinstituted law emanating from the NYC Council. Tell those you work with
about this law being back in effect.
At a time when violent crime is surging throughout New York City the past and current
members of the NYC Council displayed their total disregard for the safety of the men and
women in law enforcement throughout New York City. The Council once again demonstrated
their placing criminal advocacy above the safety of law-abiding citizens. This “Diaphragm
Law” will further paralyze police officers from initiating enforcement actions against known
criminals which will add to the kindling (i.e., Bail Reform, Raise the Age, decriminalization of
numerous quality of life offenses, etc.) fueling the increased lawlessness enveloping New
York City.

of this law being reinstated and active.

FILING A “NOTICE OF PARTICIPATION” WITH THE NYC POLICE PENSION
FUND ENDS ON SEPTEMBER 11 TH , 2022: If you responded to or took part in the
rescue and recovery efforts associated with the attacks on September 11 th 2001, please see
below.
It has been over twenty years since the September 11 th attacks and our response to
those attacks. Laws have been passed over the past twenty years to help protect us, to
monitor our health, to compensate us or our families should we become sick from 9/11
related illnesses. In order to protect yourself and your family, you need the knowledge of the
laws and programs as well as which ones you may qualify for and how to apply for them.
One such law, which is paramount to NYPD Officers, is the NYS World Trade Center
Presumption Law. Passed in 2005 and updated several times, the law allows for members to
file for a 3/4s disability pension if active or ¾ disability pension reclassification if retired and
permanently disabled due to a 9/11 classified illness. The law also provides LOD death
benefits for your family should you pass away from a 9/11 classified illness.
In order to file for the above ¾ WTC disability pension and/or WTC LOD death benefits
if you have not yet filed, the law requires that all members file a Notice of Participation (NOP)
with the NYC Police Pension Fund (NYCPPF) on or before September 11, 2022. If you have
not yet filed your NOP you can access the form at the NYCPPF website included under
Forms; Form#250.
You may have already filed your NOP. In order to confirm that you have filed a NOP
with the NYCPPF you can look to see if your Tax# is listed on the website, visit their website

VACCINE MANDATES: Lodge 100 has many Active Members from various agencies
that may be impacted by the arbitrary vaccine mandates. I respectfully request, all members

NYC MEDICARE ADVANTAGE PLUS – UPDATE: As some of you may be aware
a group of retirees were successful in their legal challenge to halt the implementation of the
NYC Medicare Advantage Plus Plan. While the legalities of implementing the NYC Medicare
Advantage Plus Plan are challenged in court the Plan will not go into effect. We have
been informed that the current legal case will not be acted upon by the court until the earliest
sometime in September. Meanwhile, Retirees will retain their current coverage until the legal
challenges are exhausted and a final determination is rendered by the court. The NYC Office
of Labor Relations, Health Benefits Section has posted the following announcement on their
website:
The NYC Medicare Advantage Plus Plan is not being implemented on April 1, 2022.
 Retirees do not need to opt out of the Medicare Advantage Program in order to remain
in Senior Care or their current plan on April 1.
 All retirees will remain in their current plans until further notice.
 We will post updates for retirees as we have more information.

MEDICARE PART B REIMBURSEMENT – ENROLLMENT: The following applies
to all NYC Retirees who go on Medicare, either by turning age 65 or collecting Social Security
Disability, and have their health insurance coverage provided by the City.
Upon you or your spouse reaching age 65, or by receiving Social Security Disability at
any age, the City of New York mandates that you accept Part A (Hospital Coverage) and
Part B (Doctor Coverage) of Medicare. The city mandates that you enroll in Part B since
the city saves money by paying less for your basic health coverage. We wish to remind our
members that they should register with the Medicare Rebate Program through the New York
City Office of Labor Relations, Health Benefits Section. The enrollment will ensure that our
members receive an annual rebate every April for the prior year’s deductions from their
Social Security checks in regard to their Medicare Premiums. For example, if you turn 65 in
July of 2022, you will receive a rebate for the six (6) months you were on Medicare for that
year; this payment will be received in April 2023. The following April of 2024, you will receive
a payment compensating you for all of 2023, and so on. For those members who receive
their Police Pension payment via direct deposit they will receive the Medicare Part B
Reimbursement as a direct deposit into the same account they receive their Police Pension
payment; this will be reflected as a separate deposit from the Pension payment. For those
members who receive a hard Police Pension check, they will receive the Medicare Rebate as
a hard check mailed to the same address in which they receive their Pension payment.

Members should be aware that if they opt not to receive Social Security payments
upon reaching age 65, but rather to wait to commence collecting at the age at which they are
entitled to maximum payment, they are still mandated to enroll in Medicare at age 65 and
should enroll in the Medicare Rebate Program. The member must pay the quarterly
premiums; Social Security will send a bill specifying the amount to be paid. The reason for
this is that when you receive Social Security payments the cost of Medicare is automatically
deducted from the SS check, when you aren’t collecting Social Security you are sent a bill.
Every April the member will receive one (1) rebate, issued to the retiree, for both
themselves and their spouse (when the spouse is on Medicare).
To enroll in the Medicare Rebate Program the member should do the following, please
remember to follow the same process when your spouse turns age 65:

are registered with Medicare Parts A and B, you should visit the following link to print out a

I am enormously proud to inform you that Memorial Lodge 100’s 18th Annual Awards Dinner is in the books. I would like to thank the Lodge Board members who were integral in ensuring the success of the event and all the attendees. Teamwork was instrumental in making this night go off without a hitch. We were so happy to have an opportunity to acknowledge and honor the Tunnel to Towers Foundation, Detective 1st Grade Louis Alvarez, and our “Member of the Year” James Scarry. The Dinner was filled with supporting organizations, agencies, lodge members and non-lodge members from around the tri state area.

 

The appreciative and touching words from our honorees and the comments from many of the Line-of- Duty families that were in the room left me humbled, emotionally touched and at a complete loss for words.

CHANGES TO THE GHI/EMPIRE BLUECROSS BLUESHIELD SENIOR CARE PLAN:

 

Retirees were mailed a letter in December 2021 regarding changes to the GHI/Empire BlueCross BlueShield Senior Care plan.  These changes were effective January 1, 2022.

 

Dear City of New York Retiree,

 

Based on negotiations with the City of New York Office of Labor Relations and the city’s unions,

represented by the Municipal Labor Committee, the following changes to your GHI/Empire BlueCross

BlueShield Senior Care plan will take effect Jan. 1, 2022:

 

After you have met your annual $233 Medicare Part B deductible and $50 Senior Care deductible, some services will also have a $15 copay. Your copay is the set dollar amount you pay for health services each time you use them. Below is a list of commonly used services that will have a copay.

 

⦁ Primary care provider (PCP) visits

⦁ Specialist visits

⦁ X-rays

⦁ Laboratory tests

⦁ Allergy testing/injections

⦁ Chiropractic services (Medicare covered)

⦁ Podiatry (Medicare covered)

⦁ Mental health and substance abuse treatment

⦁ Urgent care

⦁ Physical, occupational, and speech therapy

⦁ Cardiac rehabilitation services

⦁ Pulmonary rehabilitation services

⦁ Complex diagnostic test and radiology

⦁ Radiation therapy

⦁ Vision care (Medicare covered)

 

While this is not a full list of services with a copay, we’ve included the most commonly used services for your convenience.

 

Your Medicare Part A hospitalization coverage will continue to be covered by Medicare and Empire

BlueCross BlueShield. For questions, including questions about specific services, please call the Customer Service phone number on your member ID card.

 

 

MEDICARE PREMIUMS AND DEDUCTIBLES:  Medicare Part B: The standard monthly premium for Medicare Part B enrollees for 2022 will be $170.10; an increase of $21.60 from $148.50 in 2021. The annual deductible for all Medicare Part B beneficiaries in 2022 will be $233; an increase of $30 from the annual deductible of $203 in 2020. Part B monthly premiums are based on a person’s income. The income-related monthly adjustment amounts (IRMAA’s) are listed on the following site: https://www.medicare.gov/your-medicare-costs/part-b-costs

 

 

MEDICARE PART B REIMBURSEMENTS PAID:  On or about April 15th, most NYC Retirees on Medicare should have received the basic Part B Reimbursement in the same bank account where they receive their monthly Pension deposit. This should equate to $1,782 for an individual reimbursement and $3,564 for joint reimbursements. If you paid more than $148.50 a month for Part B then you will have to complete the forms associated with the Income Related Monthly Adjustment Amount (IRMAA) and submit the forms, with the accompanying supporting documentation, to the Office of Labor Relation: Health Benefits Section to receive the additional monies owed you. LETTER FROM THE NYPD LBA - The Cops are Doing Their Jobs - Other Parts of Criminal Justice System Result in Catch and Release of Criminals:  The following letter was constructed by NYPD Lieutenants Benevolent Association President Lou Turco and emailed to his membership. The letter effectively articulates how the members of the NYPD are properly performing their responsibilities in the criminal justice system but how the other prongs of the system are broken. This is the dystopian criminal justice system that the members of the NYPD, NYC Corrections, NYC Court Officers, and many of the other law enforcement agencies working in NYC must deal with on a reoccurring basis. This is a copy of the letter reproduced with Lou Turco’s permission:

 

Dear Lieutenant:

 

It is blatantly obvious that the men and women of the New York City Police Department are doing their job to fight crime. They are out on the streets, putting their lives on the line, to remove illegal guns from violent criminals in an effort to reduce deaths associated with gun violence. It has also become abundantly clear that the men and women of the NYPD are the only people in the criminal justice system conscientiously and effectively fulfilling their duty to protect the people of New York.

 

Other portions of the criminal justice system, specifically most District Attorneys and many judges, have more empathy for the criminal then the victim. This concern routinely results in an expeditious judicial release of violent criminals who inevitably return to the streets to victimize others. It is incredible how the District Attorneys and judges are not held accountable for their criminal advocacy.

 

I will repeat, ad nauseum, that the state legislature must listen to the people of New York and repeal the broken Bail Reform Bill. The Bail Reform Bill does not create equality in the criminal justice system, it only creates more crime, more victims, more shootings, and more murders.

 

The officers of the NYPD are responsible to enforce the law and arrest those who break the law. Our members do this daily. Sometimes they sacrifice their lives in performing their sworn duty. The District Attorneys and judges are responsible for prosecuting and detaining criminals. This is where the criminal justice system is breaking down. The reason for this is due to District Attorneys who refuse to prosecute, judges who refuse to detain violent criminals, and the criminal friendly NYS State Legislators who passed Bail Reform. 

 

This contrary and conflicted criminal justice system ultimately results in the “Catch & Release” of violent criminals. These criminals bear no accountability for their anti-social actions and pay no penalty, all to the detriment of the law-abiding citizenry. The police do their job to “Catch” the criminals but the District Attorneys, judges and the criminal advocacy legislation of the NYS Legislature result in the “Release” of violent criminals. 

 

I recently sent a communication to Commissioner Sewell requesting that the following information be provide to the LBA:

 

⦁ How many total individuals were arrested during riots of 2020 and how many of these individuals were prosecuted and convicted for the crimes for which they were arrested. 

⦁ Of the over 4,431 gun arrests made by members of the department in the year 2021, how many of the people arrested were prosecuted and convicted of illegally possessing a weapon – firearm?

FOP MOBILE APP:  To download the app, search NFOP in the Apple App Store (for iPhone) or Google Play (for Android), download the app and then register.  Once your membership is confirmed, your app registration will be approved, and you will receive a confirmation email.  Once approved, you can log in and have access to all the wonderful features and information in the app.  Please make sure to allow push notifications from the app on your phone, this way, you will receive an immediate message to your lock screen or banner at the top when breaking FOP news happens. It is also encouraged to add a profile photo to your account by clicking “more” then “settings” then “account details” to set your personal photo.

  

  There is no shortage of features on this app – and all are designed to improve communication and get you information quickly on all things happening within the Order.  There is a newsfeed, just like Facebook and Twitter, and you can scroll through videos, notifications, resources, and information the National sends out.  There are links and banner ads that you can click on that will take you directly to our one-of-a-kind COVID-19 website, the National current website, and their merchandise partners.

REMINDER TO ACTIVE NYPD: when attending Firearms qualification it is advised that you use a pancake style holster attached to your belt for your Off Duty firearm. ‘Authorized’ does not include an ankle or clip on holster. Your off duty firearm will be De-Authorized for use. 

Remember to activate your body worn camera. It is a tool to protect you. CCRB is proactively interviewing those you come in contact with. Protect Yourself.

Dear Brothers and Sisters:

 

On 09/11/2021 members of Lodge 100 gathered at the Towers of Freedom Memorial and the NYSFOP Memorial Wall, to Never Forget the Fallen and to Honor Their Memory. I was proud and speechless at the turnout of our Lodge Board Members, Active Members and a great many of our Auxiliary/Associate members in attendance. I wish to thank Rick Bermudez, Dean Roberts and Chris Bermudez for wearing their uniforms and standing as part of the Honor Guard. This 20th Remembrance along with all of the ceremonies that I am sure you attended demonstrate that our sacrifice has not been forgotten by people that are True Americans.

UPDATE TO NYC MEDICARE ADVANTAGE PLUS PLAN:  On Thursday, October 21st, state Supreme Court judge Lyle Frank, placed a temporary hold on the implementation of the NYC Medicare Advantage Plus Plan based on a law suit filed by the NYC Organization of Public Service Retirees, a group formed in opposition to the move to a privately administered Medicare Advantage plan. Frank tentatively prohibited the city and the new insurer from enforcing the planned Oct. 31 deadline for retirees to opt out of the plan. Judge Frank’s order does not, however, completely scuttle the plan: Frank wrote that he “does not intend to disturb” the city’s choice to team with the Alliance. The City’s Law Department stated that, they are reviewing the judge’s decision and that they are confident that the program will ultimately be implemented. Judge Frank also ordered that the city submit a plan for “curing the deficiencies”. The City is in the process of addressing the judge’s directives. We will keep our members apprised of the details associated with implementation of the NYC Medicare Advantage Plus Plan as they develop.

 

NYC MEDICARE ADVANTAGE PLUS PLAN:  We would like to acknowledge and thank 1st Vice President Michelle Schaefer for the incredibly thorough research and detailed synopsis of the new NYC Medicare Advantage Plus Program she provides in the following article. The information provides an in depth overview of the Plan and gives answers to many of the frequently asked questions associated with the Plan.    

 

Many of you have been expressing concerns with the new Medicare Advantage plan the City is auto-enrolling all City Medicare Retirees into which starts on January 1, 2022.  This is the largest change to City Healthcare since HIP was introduced in the 1940’s.  The Opt-out period began on Sept. 15, 2021 and continues until October 31, 2021 – The closing of the Opt Out Period is to be determined due to recent judge’s ruling.  I have been attending meetings, in person and on Zoom, to garner as much information as possible.  I have also been monitoring a very reliable Facebook group dedicated to this change.  I have picked up some information here and there across all these events and want to share them with those of you who will be impacted by this change.

 

This information only applies to New York City retirees who are covered by Medicare. This information is also available on the OLR website at: https://www1.nyc.gov/site/olr/health/retiree/health-retiree-responsibilities-assistance.page.

 

  1.  The booklets have been mailed out in batches of close to 30,000 per day, every day for the past few weeks.  They were mailed to those on Medicare/GHI Senior Care first as that covers the majority of members.  Those on other plans will receive their booklets towards the end of the mailing.  I have heard there are still many who have yet to receive this booklet.  In lieu of waiting for a booklet to arrive in the mail, the booklet can be viewed online by going to the OLR website, Health Benefits, Retirees tab and scrolling down to the links for the booklet, opt out forms, plan costs and comparisons (including a comparison of the new co-pays).  Here is the link to that page as well as 2 links to see the booklet and other plan information on Empire’s dedicated site for NYC.  Copy and paste any of them into your browser:

For questions about the new plan and participating providers, there is a dedicated phone number just for NYC Retirees.  You can call the special call center at 1-833-325-1190, Monday to Friday, 8am to 9pm.

 

There is a separate OPT-OUT form for the GHI Senior Care that is different than the form for all the other plans.  Make sure to use the correct one if you choose to OPT-OUT.  The GHI one will reference paying the $191.  The other OPT-OUT form does not reference $191 payment.

 

  1. This new plan is the City’s FREE plan.  All other plans will have a premium going forward except the Medicare/HIP VIP plan.  That will remain at $0 for 2022.  Those with the Medicare/HIP VIP do not get prescription coverage through the Unions so Part D is an additional cost for that.  There will be co-pays associated with the new plan as well as being implemented for some of the current plans.  The new plan has a cap for out of pocket co-pays.

 

  1. The buy-up cost to remain in the Medicare/GHI Senior Care will be $191 and an additional $2.83 for the 365 day Hospitalization rider per month/per member.  So, if your spouse is on your plan and you are both on Medicare it would cost close to $400 per month to remain on Medicare/GHI Senior Care in addition to the new co-pays associated with it.

 

  1. ***THIS IS IMPORTANT*****  The Pension Protection Act of 2006 allows retired Public Safety Officers (police, fire, chaplains, some EMS) to deduct up to $3000 of healthcare expenses which are paid directly from your pension (the new premiums to opt out will come from direct deductions from your pension) from your Gross income.  This should be a tremendous help to those struggling with financial burden in deciding to pay to keep your current plan or chance the new plan.  If your accountants are not familiar with this law, direct them to PUBLIC LAW 109–280—AUG. 17, 2006 TITLE VIII—PENSION RELATED REVENUE PROVISIONS Subtitle D—Health and Medical Benefits Sec. 845. Distributions from governmental retirement plans for health and long-term care insurance for public safety officers.  Those of you out on 3/4s, who do not have any taxable income, may not benefit from this law.

 

  1. The new plan is a National Network coverage plan.  Regardless of whether doctors are in or out of Network with this plan, they will still be paid 100% of the Medicare Rate.  This plan also provides coverage for foreign travel emergency and urgently needed medical services.

 

  1. Pre-auths will be required for some services prior to getting the service rather than how it is done with Medicare, you get the service then are on the hook if Medicare does not pay for it.  There are no referrals required with the new plan.

 

  1. There is a RATE SHEET effective Jan. 1, 2022 for all the plans on the OLR website.

If you opt out, you can always opt back into the new plan.  If you try the new plan in 2022 you can opt out back to your current plan for 2023.  AFTER 2023, the MEDICARE/GHI SENIORCARE will be the only other choice.  HIP/AETNA/UNITED/CIGNA/ etc. are all going away.  There is a possibility HIP will also remain but not as of now.

 

  1. Some extras included with the new plan currently not available to Medicare: Silver Sneakers program that pays for your gym membership at participating gyms.  24 one-way Non-Emergency transportation trips per year.  56 healthy meals delivered post discharge per year.  Healthy Pantry program- a monthly box of nutritious food and nutrition tips.  Wellness rewards program. 12 visits for routine foot care for all (Medicare only covers if you are diabetic).  A Fitbit every two years.  Earn gift cards for going for wellness services (i.e. physicals, cancer screenings, etc.)

 

  1. Non-Medicare dependents stay with you on GHI or HIP if you are in those plans.  You cannot mix plans.  If you take the new plan your dependents will be on GHI.  If you opt out to keep GHI Senior Care or HIP VIP they will stay on the GHI or HIP.  You cannot opt into Aetna Medicare or any other plans if you have non-Medicare dependents.  Many retirees in North Carolina and Florida, who currently have Aetna Medicare, love that plan.  Aetna Medicare is a Medicare Advantage plan so if this new Medicare Advantage plan compares to it, I would think most members will be satisfied with the new plan.

 

  1. Many are concerned their doctors will not accept this plan and never heard of it.  There is a large provider network currently participating in the BlueCross network.  Extensive provider education will be ongoing to ensure all the BlueCross providers are familiar with this new plan as well as outreach to those Medicare provider who are not participating to invite them to join as well as to inform them they will be reimbursed at the same rate as Medicare if they choose not to participate.

 

  1. Many large practices are having meetings about this plan.  Hospitals such as Memorial Sloan Kettering and others are signing contracts to participate in this new plan.

 

  1. If you have Medicare Part D, you can pay the rider for PART D in this plan as well.  If you have an outside supplemental Part D, such as through AARP, you will be automatically disenrolled in that plan and put into the new plan’s Part D. 

 

  1. ***IMPORTANT****** As long as you remain on one of the City’s plans, you will continue to get the Medicare Reimbursement and the IRMAA if it applies.  If you opt to take an outside insurance plan such as a spouse’s plan or AARP Medicare supplemental insurance, YOU WILL NOT GET THE MEDICARE REIMBURSEMENT OR THE IRMAA.  You MUST be on a CITY plan to be reimbursed.

 

  1. Non-LOD widows who pay for COBRA will have the opportunity to OPT-IN to the new plan during the Nov. changeover.  This will drastically reduce what they are paying for COBRA for 2022 from $194 to less than $10 a month.  Rumor has it, that premium is supposed to cost $0 for them for 2023.

 

  1. The following information is subject to change due to recent judge’s ruling. IF YOU PLAN TO OPT-OUT MAKE SURE TO DO IT BEFORE THE OCT. 31 DEADLINE.  If you want to join a different plan than what you currently have, you must do the “Once in a lifetime change” BEFORE October 31, 2021.  Once you are in the new plan, you then must OPT-OUT of the new Medicare Advantage Plus Plan. 

 

  1. This new plan is a 5 year contract so it should remain unchanged through 2026.  What happens after the 5 years is anyone’s guess.  However, the costs associated with remaining in your current plan will most likely change going forward.  As fewer members will participate in them, the cost will likely

URGENT! GET OUT & VOTE:  Early voting is open now and Election Day is Tuesday, November 2nd. The need to have our voices heard at the ballot box has never been more urgent than now. Over the past years and even more so recently, our current elected politicians have passed legislation making the job of law enforcement much more difficult and much more dangerous. All while making things more advantageous for criminals and to the detriment of the safety and quality of life for all New Yorkers. Members of law enforcement and their families need to make sure their voices and votes are heard. Only by voting for elected public officials, who realize the necessity for law and order and to keep criminals in prison so that they cannot continue to prey and victimize innocent civilians, can we potentially make things safer for our police officers, residents and visitors to the city.

We cannot stress enough how important it is for you, your family, and your friends to vote in the upcoming elections during these troubling times where law enforcement is under attack. Please take the time to vote for those politicians who have shown their support of law enforcement.

 

 

VOTE “NO” ON BALLOT PROPOSALS 1,3, AND 4:  There are several ballot proposals that work counter to our interests and need your attention when you and your family members vote this election day.

Ballot Proposal #1 relates to the redistricting amendment passed by voters in 2014. Proposed changes would weaken the process before it has been given a chance to work. It allows incarcerated prisoners to be counted at their last known place of residence and requires the state to count all residents regardless of their citizenship status.

 

Ballot Proposal #3 relates to same day voter registration, eliminating the requirement to register at least 10 days prior to an election. These new registrants could register at voting locations where poll workers will be unable to verify their proof of residency and eligibility to vote. Once this occurs these newly registered voters would utilize machine voting instead of affidavit ballot making it impossible to disqualify the vote should it be determined to be ineligible.

Ballot Proposal # 4 relates to excuse free absentee voting. The proposal weakens the language regarding absentee voting making it so generic it opens the door to a host of issues such as ballot harvesting, and unverified internet voting. It also eliminates the underlying reason for absentee balloting: a voter being absent from their county or unable to appear at a voting site due to illness or physical disability.

 

We encourage you and your family members to get out and vote and to vote NO on these three ballot initiatives.

 

 

How to Safeguard Tax, Financial Information

The IRS and the New York Department of Taxation and Finance remind taxpayers to be vigilant against scammers and identity thieves.

     Be wary of aggressive phone scams. Remember, the IRS and New York State Tax Department will contact you by mail first and never threaten you over the phone or demand payment be made through MoneyGram, Western Union or other wire transfers; or using iTunes, Greendot or other cash and gift cards.

     Avoid phishing scams. Taxpayers may receive emails with authentic-looking government logos that offer assistance in settling fake tax issues. The state Tax Department and IRS will never request personal or financial information by email

 

Use strong passwords. Don't use your name, birth date or common words. Use a different password for each of your accounts.

     Use secure wireless networks. Always encrypt your wireless network with a strong password. Never access your personal accounts on a public Wi-Fi network.

     Review bank accounts and statements. Check your credit-card and banking statements regularly to spot any suspicious activity.

     Review credit reports annually. Review each of your credit reports annually to spot any new lines of credit that you didn't apply for or authorize.

     Think before you post. Information and photos you share with social media, including current and past addresses, or names of relatives, can provide scammers possible answers to your security questions or otherwise help them access your accounts.

 

     Secure tax documents. Store hard copies of your Federal and NYS tax returns in a safe place. Digital copies should also be saved. Shred documents that contain personal information before throwing them away.

     Review and respond to all IRS and NYS Department communications. You should review and respond to all notices sent. Any unexpected correspondence can be a potential sign that your identity has been stolen. It's important that you contact the IRS or the NYS Tax Department immediately to confirm any liabilities.

     Following these guidelines may help to ensure a smooth sailing during and after tax season.

LODGE 100 2021 RAFFLE TO BENEFIT TUNNEL TO TOWERS:  Most of our members should have received your Lodge 100 2021 Raffles in the mail. A portion of the raffle sales will go to support the Tunnel to Towers Foundation. Tunnel to Towers Foundation has spent over $250 million to honor and support fallen or severely wounded first responders as well as veterans and their families. In 2020 alone, Tunnel to Tower delivered mortgage-free homes to:

·        6 Gold Star families

·        3 Catastrophically injured veterans

·        1 Catastrophically injured first responder

INCREASE OF FOP MEMORIAL LODGE 100 ANNUAL DUES: It has been many years since the  Lodge had raised the annual dues for membership. Recently external issues have made it necessary for the Lodge to consider raising our annual dues:

Over the years, the Lodge has experienced approximately three (3) dues increases by the National and State FOP’s. The Lodge, for over a decade, had absorbed these increases without raising the members’ dues, however, the most recent increase is to cost prohibitive to absorb.

The general operational costs associated with the Lodge have increased over the years. At the last Executive Board meeting, a motion to raise the Memorial Lodge 100’s  Annual Dues by ten ($10) dollars was introduced by President Rich Clifford, 2nd Rick Bermudez and endorsed by the entire Executive Board. The motion was then made to the general membership in attendance  at the May meeting.  The motion was unanimously approved by the Lodge Executive Board and the general membership in attendance, with no objections.

 

The annual dues increase would now be (starting with the 2022 membership year):

 

Active Member = $60

Auxiliary Member = $60

Associate Member = $90

 

 

OPEN LETTER FROM NYPD LBA PRESIDENT TO HIS MEMBERSHIP:  LBA President Lou Turco sent the following communication to his membership articulating how the New York State and New York City politicians have abandoned and insulted the members of the NYPD. His letter could eventually apply to so many of the other law enforcement entities throughout the state and the city.

 

Dear Lieutenant:

A definition of an “insult” is, “speak to or treat with disrespect or scornful abuse”. Based on this definition, our politicians in Albany and New York City, routinely single out and “insult” the members of the New York City Police Department. These politicians demonstrate their contempt for the members of the NYPD by drafting and passing legislation explicitly designed to negatively impact on the members of the NYPD. No other law enforcement entities in the state are impacted by these disrespectful pieces of legislation, policies or actions.

 

      The New York City Council voted overwhelmingly to “Defund the Police”. The NYPD is the only law enforcement entity in the entire State of New York to be “Defunded”. The New York City Council only voted to Defund one city agency - the NYPD.

You should be insulted.

 

      The New York City Council enacted the incredibly restrictive and reckless, “Diaphragm Bill”; which places the members of the NYPD and the general public in greater danger of being injured by violent criminals. The NYPD is the only law enforcement entity in the state subject to this dangerous and ridiculous law. You should be insulted.

 

      This past summer the country, New York State and New York City experienced violent protests considered by many to be acts of Domestic Terrorism. In preventing the city from being completely destroyed, over 400 hundred members of the NYPD were injured, some seriously, and there were several attempts to kill members of the NYPD. In regard to the protests/riots/looting/domestic terrorism, Letitia James, Attorney General of New York, filed a civil suit against only one law enforcement entity in the entire state – the New York City Police Department. You should be insulted.

 

The New York City Council drafted and voted to remove “Qualified Immunity” from the members of the New York City Police Department. This legislation makes the NYPD the only law enforcement entity in the state, in the country, to lose “Qualified Immunity”. You should be insulted.

 

      As violent crime spirals out of control, and more and more city residents are shot and killed, these politicians seem to relish in making our job more dangerous and difficult. You need to be aware that a majority of our state and city elected officials have zero respect for you and do not support the members of the NYPD. You have been abandoned and have every right to feel INSULTED.

1)The 2022 Renewal Form, can be downloaded at the following address: www.nysfoplodge100@aol.com.

2) If possible, fill out the form on your computer, then print it out, sign it, include your annual dues payment (please take note of new dues amount) and mail to the Lodge. If you have any changes from 2021 please check the box in the upper right corner. Your renewal application will not be processed if it does not include your dues payment.

3) Please do not send in a renewal that simply says, “Same as Last Year”. A current completed application is required for your insurance qualifications.

4) Please provide your email address on your renewal application. Most of our Newsletters are now sent primarily via e-mail; only two (2) Newsletters per year go out hard copy via the US Mail. This is a cost savings for the Lodge and reduces the labor intensive mailing process performed by the VOLUNTEERS, to complete these administrative tasks.

COPS AREN’T IMMUNE TO SCAMS AND IDENTITY THEFT - PROTECT YOURSELF

Scams and Identity theft are big business.  Billions of dollars are stolen every year from trusting Americans.  Recently eight (8) perpetrators were arrested in New York City regarding a $2 million Unemployment Scam.  The perps were caught on video at several banks withdrawing funds from numerous cards in victims’ names.  Some of the perps were arrested more than once, for other crimes, and found in possession of unemployment benefit cards in the victims’ names. Addresses were changed so their victims would not receive any communications from New York State.

 

The COVID-19 Vaccinations are free. Do not pay money to anyone over the phone for an appointment, Doctor’s exam, testing or prepay for the shots.  They may bill your insurance, but you will not be responsible for the testing or vaccines if your insurance does not pay.  You may be billed for an office visit depending where you go for the shot.  Ask questions regarding fees before you go.

  

Beware of anyone calling with other common phone scams such as someone telling you a family member needs money for bail, medical care, to pay for accident damages, and the like.  They will even put a crying girl or boy on the phone who sounds like your relative.  They will call you grandma or grandpa, etc. and when you say a name, they will play off it and say “yes, it’s me! Don’t tell my parents please.” etc.  They will arrange to meet you to get the cash from you or have you drop it at a broker.  They may even have you buy a money card. As soon as you give them the number of the card, your money is gone.  Also be aware of Romance scams through social media or dating websites.  They may ask for travel money to come see you or a loan, etc.

 

Fraudsters are targeting the public by emailing or calling you up and duping you by asking you to verify the info for your Address, Birthdate, Social Security #, Medical Insurance ID #s, Credit/Debit card #s, PIN #s, CVV codes and expiration dates.  They do this by spoofing phone numbers to make it appear they are calling from a medical/financial institution that you are associated with.  They may also threaten you with arrest if you don’t pay the fine or taxes they claim you owe.  The fraudsters attempt to use the information to commit fraud on your accounts.

 

We would like to remind you that you should never give out your personal, medical, or banking information in response to an unsolicited phone call, email, text message, or fax even if the caller or sender identifies themselves as being from a trusted source.  Go to a bill or the back of your card and call them back so you know you are calling an official phone number.

 

There are many scams that are being perpetrated on trusting people, especially seniors.  Some common scams are:

·        Romance Scam- Criminals pose as a romantic interest on social media.  Ask for money to pay fare to visit.

·        Tech Support Scam- Criminals call offering to fix computer problems.  They ask to take control of your computer and access your sensitive information.

·        Grandparent Scam- Criminals pose as a relative (child or grandchild) claim to need money immediately for bail, pay for accident damage, for medical care, stranded out of State/Country.

·        Government Scam- Criminals pose as IRS and threaten arrest if back taxes are not paid immediately (the IRS will NEVER call you).

·        Sweepstakes/Lottery Scam- Criminals offer part of their winnings if you pay processing fee or a good faith amount to prove yourself

·        Charity Scam- Criminals claim they are legitimate charity (beware of donating to Charitable phone calls even if your caller ID shows what appears to be a charity).

·        Home Repair- Offer to perform repairs and need money up front.  Then never finish the work or never start it.

·        Real Estate Scam- Scammers sell your home out from under you.  Reverse mortgages, although legit, may not be good.

·        Financial Scam- Offer mortgages, Reverse mortgages or credit repairs but are not legitimate.

·        Medical Scam- Criminals will call and offer free back or knee braces or pain creams and ask for your Medicare.  They may already have your name and other info or ask you to confirm your Medicare number.

·        Utility worker- Criminals pose as Utility workers needing access to your home for repairs.

·        Distraction Scam- One person approaches and distracts you with a problem while another pickpockets you.

 

Do not give or send money to anyone over the phone unless you initiated the call.  Do not get a gift card or money card.  The money will be wiped off the card as soon as you tell them the card number.  Do not wire money or give money to a broker or car service sent to pick it up.  Do not donate to charities over the phone.  Do not give your medical information to anyone over the phone.   Do not trust the name/numbers on your caller ID.  Criminals can route their call through a legit appearing phone number.

 

Make sure to contact your local Law Enforcement Agency if you believe your or a family member were a victim of a scam.  Be prepared to give the following information:

·        Name of Scammer or Company and Date(s) of scam or contact

·        Means of contact (mail, email, phone, in-person, Social media)

·        All names/phone numbers/addresses/email addresses/Websites used by the scammers

·        Method of payment (cash, money order, money card, gift card, credit card, wire transfer)

·        How money was delivered (over phone, wire transfer, broker, pick-up)

·        Financial institution/Bank/Phone numbers used to accept the money from you

·        Describe person if in person contact, describe conversation, details of scam, instructions given to you

·        Keep all documents related to scam (email, wire transfer, money card, gift card, fax logs, call logs)

 

Check your bank (checking, savings) accounts, stock/brokerage accounts, 457/401Ks, etc. for unauthorized transactions.  Ensure your account information (name, address, phone numbers, emails) are yours and haven’t been changed.   Set up a family “code word or phrase” that only you and your family would know so that you can verify if the call is legitimate.  If you get a call regarding a family member in financial distress, ALWAYS confirm if the story is true with other family members who would or should know what happened.  Do not worry about protecting the caller (supposed child/grandchild) from “getting in trouble”.  DO NOT use a Debit card to routinely make purchases.  Credit cards will usually remove unauthorized charges but your bank account can be wiped out by unauthorized debit access which may not be refunded.  Also, sadly, beware of being scammed or ripped off by someone you know.  Trusted friends, family, and caregivers have been known to take advantage of seniors who unwittingly trust them or otherwise get their money or belongings.  Check your credit report regularly.  Ensure there are no new accounts/loans that were not opened by you.  Check with your State Unemployment Office to ensure benefits were not filed under your information.  Financial crimes are big business. 

 

 

COVID-19 RELATED FUNERAL FINANCIAL ASSISTANCE:  If any Lodge #100 member, or anyone you know of, had to bury an individual due to a death caused by the COVID-19 Virus the information to be reimbursed, for up to $9,000.00 in expenses, for the funeral is below. Please read the guidelines. Everyone affected by this virus is eligible. Presently, there are no financial caps regarding income for a person’s eligibility to file a claim. Who is Eligible?

To be eligible for funeral assistance, you must meet these conditions:

§  The death must have occurred in the United States, including the U.S. territories, and the District of Columbia.

§  The death certificate must indicate the death was attributed to COVID-19.

§  The applicant must be a U.S. citizen, non-citizen national, or qualified alien who incurred funeral expenses after January 20, 2020.

§  There is no requirement for the deceased person to have been a U.S. citizen, non-citizen national, or qualified alien.

 

If you had COVID-19 funeral expenses, we encourage you to keep and gather documentation. Types of information should include:

§  An official death certificate that attributes the death directly or indirectly to COVID-19 and shows that the death occurred in the United States, including the U.S. territories, and the District of Columbia.

§  Funeral expenses documents (receipts, funeral home contract, etc.) that includes the applicant’s name, the deceased person’s name, the amount of funeral expenses, and the dates the funeral expenses happened.

§  Proof of funds received from other sources specifically for use toward funeral costs. We are not able to duplicate benefits received from burial or funeral insurance, financial assistance received from voluntary agencies, government agencies, or other sources.

 

How Funds are Received

If you are eligible for funeral assistance you will receive a check by mail, or funds by direct deposit, depending on which option you choose when you apply for assistance.

Rhetorically I ask, why are these tragic and senseless attacks on society the headline news report on every news outlet? Please keep the above Officers in your thoughts and prayers. My heartfelt thanks to Lodge 100 Executive Vice President Michelle Schaefer for continuing this tradition at each of our in-person meetings.

 

Once again, our annual March corned beef and cabbage meeting repast was an overwhelming success thanks to the dedication of Lodge 100 Associate Trustee Pete Bilardello who shopped, prepared and served our meeting attendees a traditional corned beef, cabbage and potato meal.

 

The NYC Council recently passed a bill removing qualified immunity from NYPD officers.  Calling this move, by the hate filled NYC elected officials, disgusting, is an understatement.  For the hundreds of NYPD Lodge 100 members, whose physical lives have been minimized, now whose economic lives have also been minimized.  The FOP may have a product to assist, see Rick Bermudez’s State Trustee Report below.  If you feel this product may be of value to you as an Active FOP member, reach out to members of your command.  They are more than welcome to join Lodge 100 as an active member to avail themselves of the FOP’s Legal Defense program. As you are aware, due to the pandemic, it was necessary to cancel both the 2020 and 2021 annual awards dinners.  Our 2020 Law Enforcement Supporter of the Year was the Tunnel to Towers Foundation. Due to the pandemic, we were not able to properly recognize their commitment in supporting our first responders in need.  In an effort to demonstrate our support for their efforts to fulfill their commitment to Law Enforcement Survivors, your Executive Board felt the need to assist their work.  Your Lodge’s 2021 Raffle will be for the benefit of the Tunnel to Towers Foundation.  The raffle is not limited to Lodge members.  I encourage you to reach out to your own networks of Family & Friends to participate.

NYS FOP STATE TRUSTEE REPORT:

 

Brothers and Sisters,

I hope this message finds you and your loved ones well. For a long time, you have heard me speak of the anti-Law Enforcement attitude exhibited by our politicians as well as those groups who have their own anti- Law Enforcement agenda.

Recently they went one step further. On March 25, 2021, the NYC Council repealed Qualified Immunity of New Your City Police Officers. This is a devastating piece of legislature against members of New York City Law Enforcement.

Although the City Council has voted to repeal the law, the law must be presented to the Mayor for it to become effective. However, he has already made public statements confirming that he supports the repeal of qualified immunity and he is expected to sign the legislation into law sometime in the coming weeks.

The Executive Board of Lodge 100 wants you to know that the FOP is here for you to provide whatever support we can in these trying times. Today it comes in the form of information. In most cases when the city declines to provide representation against suits you are named in, your line organization will then represent you in this costly undertaking.

However, we’d like to further advise that actively working members of the FOP can seek to enroll in the National FOP Legal Defense Plan. Although membership in the FOP does NOT automatically include such coverage, your membership may allow you to avail yourself of this additional coverage at minimal cost to you.

I have included a recent article written by National Treasurer Tom Penoza for the December 2020 National FOP Journal. In his article Tom spoke of the benefits of the National Legal defense Plan coverages. Given the current anti-Law Enforcement climate, I found the article informative and timely.

COVID – 19 VACCINE INFORMATION:  According to The CDC's data tracker, as of 6 a.m. EDT April 1, a total of 200,496,635 vaccine doses had been distributed in the U.S., and 153,631,404 had been administered, or 76.63 percent. Additionally, 99,565,311 people had received at least one dose of the vaccine, and 56,089,614 had been fully vaccinated. That means 30 percent of the U.S. population had received at least one dose of the vaccine, and 16.9 percent had been fully vaccinated. 

 

Below are the stats for New Jersey, Connecticut and New York, ranked by the percentage of COVID-19 vaccines they've administered of those that have been distributed to them.

In addition to the Veterans Administration providing COVID – 19 vaccinations to all veterans, the New York City Police Department is now providing the vaccine (Moderna and/or Pfizer), on differing dates and locations to retired Members of the Service, their qualifying eligible dependents and qualifying immediate family members. Many of the law enforcement unions and fraternal organizations (the LBA and the Retired Lieutenants Association) e-mail out the Department FINEST Message(s) informing their members of the dates, times, locations and types of vaccines being administered Please monitor your e-mails for these announcements.

 

For those members of the FOP who can not receive the vaccine from the VA or NYPD here is some information and resources to help you receive the vaccination:

 

Vaccine eligibility in New York State: As of March 30th, New York Residents age 30 and older are eligible to receive the COVID – 19 vaccine. Starting April 6th, New York Residents age 16 and older will be eligible to receive the COVID – 19 vaccine. There are currently three vaccines available; the Pfizer and Moderna vaccines require two separate injections to reach maximum effectiveness, the Johnson and Johnson vaccine only requires one injection but has a lower efficacy rate than the other two vaccines. NYC COUNCIL VOTES TO REMOVE QUALIFED IMMUNITY FROM THE NYPD:  On Thursday, March 25th, the New York City Council in their ongoing campaign to cripple the New York City Police Department voted to pass a bill removing the legal protections provided by Qualified Immunity from the New York City Police Department and its officers. The legislation was sponsored by Brooklyn Councilman Stephen Levin; Intro. 2220-A ends qualified immunity for police officersNew York is the first city to pass legislation that would allow citizens to sue police officers for excessive force or unlawful searches and seizures without first overcoming the high hurdle of qualified immunity. 

 

Qualified Immunity is only being removed from members of the NYPD; an agency working for New York City and enforcing the laws and policies of New York State and New York City. Incomprehensibly, elected officials and all other City workers, i.e. Corrections Officers, EMT’s, Fire fighters, teachers, city social workers, etc., retain their Qualified Immunity. Qualified immunity applies to all government workers, whether local, state, or federal (some of them might get even greater protections, like prosecutors and judges who are protected by “Absolute Immunity”, but all can take advantage of qualified immunity at a minimum). This includes, for example, mayors, governors, medical board inspectors, prison guards, school administrators, IRS agents, and everyone else who works for the government, as well as private individuals who act jointly with government workers or undertake governmental tasks, such as private prison operators and ankle-monitoring companies. Obviously, this legislation is just another example of the prejudicial animosity the City Council has for the New York City Police Department and its officers.

 

The legal doctrine is supposed to protect state actors from vacuous civil suits. Qualified immunity is the practice of not being able to file a civil lawsuit against a government official performing his or her official duties unless they "clearly established statutory or constitutional rights of which a reasonable person would have known."

 

Per the bill, victims of police misconduct would be able to sue officers under local statutes, as qualified immunity remains in place at the federal level. Colorado and Connecticut last year passed similar pieces of legislation, and several other states are considering joining them, including New Mexico and Florida.

 

The NYC bill adds a new chapter to the NYC Administrative code, which establishes a local right to be free from excessive force and unreasonable searches and seizures. This right is designed to mirror the Fourth Amendment, and the legislation calls for it to be interpreted the same way. But it also allows citizens to sue police for the deprivation of that right, while explicitly providing that “qualified immunity or any other substantially equivalent immunity” will not shield officers from responsibility.

 

It’s not just individual police officers who are held accountable, either. The reform measure takes the major step of holding officers and their departments liable for violations of a citizen’s Fourth Amendment rights. Effectively, this creates two layers of accountability. If the officer isn’t able to pay for the damage caused, aggrieved individuals can also seek compensation from the officer’s employer. The bill also provides that prevailing plaintiffs may seek both attorney’s fees and punitive damages. It’s even possible to sue in equity: thus, if a police officer took a valuable keepsake while searching someone’s house, a person can sue to have the specific item returned instead of just the item’s monetary value.

What Is Qualified Immunity?

Qualified immunity is a judicially created doctrine that shields government officials from being held personally liable for constitutional violations—like the right to be free from excessive police force—for money damages under federal law so long as the officials did not violate “clearly established” law. When government officials are sued, qualified immunity functions as an affirmative defense they can raise, barring damages even if they committed unlawful acts. (Qualified immunity is not, however, a defense to claims for injunctive relief.)

 

How Does Qualified Immunity Work?

The landmark case of Harlow v. Fitzgerald (1982) articulated the modern formulation of qualified immunity that controls today. Jettisoning past precedent that examined the “subjective good faith” of the officer who committed the alleged violation, the Harlow court adopted a new test framed in “objective terms.” In Harlow, the court established that a plaintiff could overcome qualified immunity only by showing that the defendant’s conduct “violate[d] clearly established statutory or constitutional rights of which a reasonable person would have known.” While the court made clear that the new standard was intended to be more protective of government officials than its previous test, the court also stated that the standard “provide[d] no license to lawless conduct.”

 

What Is the Justification for Qualified Immunity?

In general terms, the Supreme Court has offered two basic justifications for the doctrine. The Harlow Court expressly noted that its decision sought to achieve a “balance” between allowing victims to hold officials accountable and minimizing “social costs” to “society as a whole.” Noting that “claims frequently run against the innocent, as well as the guilty,” the Harlow court identified four “social costs.” First, the doctrine aims to avoid “the expenses of litigation” by allowing district courts to dismiss suits against officers at early stages in the litigation. Second, and relatedly, requiring officials to respond to such litigation can “diver[t] … official energy from pressing public issues.” Third, the court worried that the threat of litigation would “deter [] … able citizens from acceptance of public office.” And lastly—and most importantly—the court was concerned that the threat of lawsuits could chill lawful law enforcement conduct. The court wrote that “there is the danger that fear of being sued will ‘dampen the ardor of all but the most resolute, or the most irresponsible [public officials], in the unflinching discharge of their duties.’” 

 

Also, at the core of the Supreme Court’s jurisprudence is the contention that it would be unfair to hold government officials to constitutional rules they were not aware of at the time of the violation. The court first articulated this idea in a pre-Harlow decision, stating that “[a] policeman’s lot is not so unhappy that he must choose between being charged with dereliction of duty if he does not arrest when he has probable cause, and being mulcted in damages if he does.”

 

      The removal of Qualified Immunity is not a local threat to law enforcement, In Congress, the elimination of qualified immunity for members of law enforcement was included in the “George Floyd Justice in Policing Act,” introduced by Democrats in the House of Representatives, as well as its companion bill in the Senate. The “Ending Qualified Immunity Act” introduced by Justin Amash in the House (the first ever “tripartisan” bill, with Republican, Democratic, and Libertarian co-sponsors) went further and would have eliminated qualified immunity for all public officials. And Mike Braun, a Republican senator from Indiana, introduced the “Reforming Qualified Immunity Act,” which would have substantially cut back on the scope of the doctrine. While none of these particular bills were passed, qualified immunity reform will remain a pressing question for Congress.

 

 

NATIONAL RIFLE ASSOCIATION – INSTITUTE FOR LEGISLATIVE ACTION ARTICLE - NY Hospital Study: Shilling for the Safe ActWe would like to thank FOP Lodge 100 Sergeant-at-Arms Dave Furman for bringing this article to our attention. The FOP understands the nexus between mental health and the ability to legally possess a weapon, however the following program, as described in the article, is applied too broadly, may have the unintentional result of people avoiding receiving mental health assistance, and also deprives people caught up in the process from access to due process.

 

In summary, the article, published on October 5th, 2020, informs the reader of a program initiated by Northwell Health, the largest health system and largest private employer in New York State, entitled, “We Ask Everyone. Firearm Safety is a Health Issue.” The project will require, as part of routine screening of emergency room patients, asking questions about firearm ownership and guns in the home. Implementation will begin at three Northwell hospitals initially (two on Long Island and one on Staten Island), with plans to expand the program to include “inpatient and ambulatory settings” across all of its facilities.

 

Under 2013’s SAFE Act, an amendment to the state Mental Hygiene Law created a mandatory reporting requirement for mental health professionals. Physicians, psychologists, registered nurses, and licensed clinical social workers providing treatment services are now required to report any client that, in the exercise of reasonable professional judgment, the treatment provider considers “likely to engage in conduct that would result in serious harm to self or others.” If a local government official agrees with the report, the report must be shared with the New York State Division of Criminal Justice Services to disarm persons in possession of a state firearms license and guns.

Persons who have been reported do not have access to the report or to the name of the reporting treatment provider. There is no due process, hearing, adjudication of mental illness or determination of dangerousness, or a requirement for a court order. Once the division of criminal justice services is notified, if the person has a firearm license or has applied for one, the license is automatically revoked, and the person must surrender the license and all firearms, or the firearms will be confiscated by law enforcement. 

 

The New York State Psychiatric Association, an association representing psychiatrists practicing in the state that “supports gun control measures in general,” opposed the reporting requirement and its focus on guns rather than mental health: “Following discussions with OMH [New York State Office of Mental Health] staff, it has become clear that the intent of the SAFE Act reporting requirement is solely to limit access to legal firearms and not to protect individuals from imminent risk of harm to self or others.”

 

Under the Northwell project, regardless of the reason a person presents themselves at the emergency room –food poisoning, car accident, or COVID -19 – the patient will face questioning about guns. In a public health context where firearms are viewed as unhealthy and gun ownership as pathological, it isn’t terribly hard to imagine how this information may be used to support a claim that a gun owner “is likely to engage in conduct that would result in serious harm to self or others.”

 

While New York’s website advises that the SAFE Act “should not dissuade any individual from seeking mental health services they need,” the reality is that it forces gun owners to choose between getting such treatment and retaining their gun rights, and makes everyone less safe. “We Ask Everyone” implicates the same dysfunctional dynamic.

Dear Brothers and Sisters:

 

As I put pen to paper, I am horrified at the continued unwarranted attacks on Law Enforcement not only in the form of physical violence by the dregs of society as well as from disingenuous media and politicians. I was especially horrified by verbal attacks, coming from the most powerful elected official on earth during a Town Hall event on 2/16/2021.

 

I assure you; these feelings are not how we are looked at by the vast majority of the citizens that we have served and continue to serve. I urge you to hold the line and be strong. Now, more than ever, we must stand together with our common bond within our law enforcement community.  As many of you have witnessed, numerous local, state, and federal politicians have fomented a culture of contempt for law enforcement. Meanwhile many of these same political candidates petition the FOP for endorsements, and as Rick Bermudez and I both hold office in the New York State FOP Board, be assured that we will only vote to support those candidates that show and express support for law enforcement.

 

While here in the Northeast, winter is on the wane, our Brothers & Sisters in Texas have gone through a bout of cold weather not experienced in over 100 years. We have several Lodge 100 Members residing in Texas. We reached out to our Texas Lodge 100 Brothers and Sisters and I am happy to report almost all members have responded that they are OK.

 

Our condolences go out to the family of Officer Harry Ryman whose killer has been freed by the Cuomo Administration. Not even Cuomo’s recent karma can dull the pain of this heartless and disgusting decision.

 

As you are aware, due to the pandemic, it was necessary to cancel both the 2020 and 2021 annual awards dinners. Our 2020 Law Enforcement Supporter of the Year was the Tunnel 2 Towers Foundation. Due to the pandemic, we were not able to properly recognize their commitment in supporting our first responders in need. In an effort to demonstrate our support for their efforts to fulfill their commitment to Law Enforcement Survivors, your Executive Board felt the need to assist their work. Your Lodge’s 2021 Raffle will be for the benefit of the Tunnel 2 Towers Foundation.  In the coming weeks, you will receive the opportunity to assist. H.R. 127, Sabika Sheikh Firearm Licensing and Registration Act:  On January 4, 2021, Texas Congress Member Sheila Jackson Lee (Texas-D-18th Congressional District) introduced the aforementioned Bill into the House of Representatives. The purpose of the Bill isTo provide for the licensing of firearm and ammunition possession and the registration of firearms, and to prohibit the possession of certain ammunition.” Some major portions of the Bill include:

Chapter 44 of title 18, United States Code, is amended by adding at the end the following:

  • “§ 932. Licensing of firearm and ammunition possession; registration of firearms

“(a) In General.—The Attorney General, through the Bureau of Alcohol, Tobacco,

Firearms and Explosives, shall establish a system for licensing the possession of firearms or ammunition in the United States, and for the registration with the Bureau of each firearm present in the United States.

  • “(3) DATABASE.—

“(A) IN GENERAL.—The Attorney General shall establish and maintain a database of all firearms registered pursuant to this subsection.

“(B) ACCESS.—The Attorney General shall make the contents of the database accessible to all members of the public, all Federal, State, and local law enforcement authorities, all branches of the United States Armed Forces, and all State and local governments, as defined by the Bureau.

  • PSYCHOLOGICAL EVALUATION.—A psychological evaluation is conducted in accordance with this paragraph if—

“(A) the evaluation is conducted in compliance with such standards as shall be established by the Attorney General;

“(B) the evaluation is conducted by a licensed psychologist approved by the Attorney General;

“(C) as deemed necessary by the licensed psychologist involved, the evaluation included a psychological evaluation of other members of the household in which the individual resides; and

“(D) as part of the psychological evaluation, the licensed psychologist interviewed any spouse of the individual, any former spouse of the individual, and at least 2 other persons who are a member of the family of, or an associate of, the individual to further determine the state of the mental, emotional, and relational stability of the individual in relation to firearms.

  • “(d) FIREARM INSURANCE.—

“(1) IN GENERAL.—The Attorney General shall issue to any person who has applied for a license pursuant to subsection (c) and has paid to the Attorney General the fee specified in paragraph (2) of this subsection a policy that insures the person against liability for losses and damages resulting from the use of any firearm by the person during the 1-year period that begins with the date the policy is issued.

“(2) FEE.—The fee specified in this paragraph is $800.”.

  • “(2) It shall be unlawful for a person to sell or give a firearm or ammunition to another person unless the person has notified the Attorney General of the sale or gift.
  • (2) PENALTIES.—Section 924(a) of such title is amended by adding at the end the following:

“(8) Whoever knowingly violates section 922(aa) shall be fined not less than $75,000 and not more than $150,000, imprisoned not less than 15 years and not more than 25 years, or both.

“(9) (A) Whoever knowingly violates section 922(bb)(1) shall be fined not less than $50,000 and not more than $75,000, imprisoned not less than 10 years and not more than 15 years, or both.

“(B) Whoever knowingly violates section 922(bb)(2) shall be fined not less than $30,000 and not more than $50,000, imprisoned not less than 5 years and not more than 10 years, or both.

“(C) Whoever knowingly violates section 922(bb)(3) shall be fined not less than $5,000 and not more than $10,000.

“(D) Whoever knowingly violates section 922(bb)(4) shall be fined not less than $75,000 and not more than $100,000, imprisoned not less than 15 years and not more than 25 years, or both, except that if the transferee of the firearm possess or uses the firearm during or in relation to a crime, an unintentional shooting, or suicide, the transferor shall be fined not less than $100,000 and not more than $150,000, imprisoned not less than 25 years and not more than 40 years, or both.

“(10) Whoever knowingly violates section 922(cc) shall be fined not less than $50,000 and not more than $100,000, imprisoned not less than 10 years and not more than 20 years, or both.”.

  • SEC. 3. PROHIBITION ON POSSESSION OF CERTAIN AMMUNITION.

In General.—Section 922 of title 18, United States Code, as amended by section 2 of this Act, is amended by adding at the end the following:

“(dd) (1) It shall be unlawful for any person to possess ammunition that is 0.50 caliber or greater.

“(2) (A) It shall be unlawful for any person to possess a large capacity ammunition feeding device.

b) Large Capacity Ammunition Feeding Device Defined.—Section 921(a) of such title, as amended by section 1 of this Act, is amended by inserting after paragraph (30) the following:

“(31) The term ‘large capacity ammunition feeding device’ means a magazine, belt, drum, feed strip, or similar device that has a capacity of, or that can be readily restored or converted to accept, more than 10 rounds of ammunition, but does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.”.

KILLER OF NYPD POLICE OFFICER HARRY RYMAN PAROLED:  The night of August 15th, 1980 was like any other night for the Ryman family. The seven members of the family, including Harry, had all eaten dinner at six o’clock as was the norm. Eventually everyone retired to their beds. At around 0330 hours Harry was awoken by the noise of someone trying to break into his neighbor’s car. Harry grabbed his gun and shield and confronted the perp, later identified as Paul Ford. Ford fired at Ryman and Ryman returned fire. Ryman struck Ford, but two of Ford’s cohorts came running when they heard the gun fire and opened up on Ryman, striking and killing him. All three perps would eventually be captured, convicted and jailed. However, 42 years later, as what now is commonplace, the Governor Cuomo appointed Parole Board has released all three of the perps responsible for murdering Police Officer Harry Ryman; Paul Ford was the most recent to be paroled. As Harry’s daughter Margaret stated in a NY Post article, “We always believe that as victims of a crime, especially the children of a murdered police officer, we would have a voice. We would be heard.” She blames Gov. Cuomo. “Under this new program of parole reform, there’s so much emphasis on the inmates. They have more rights than we do. Cuomo has really made it a point to silence us. He’s picked every one of the parole commissioners. He wants everyone let out. Well, if the governor really believes they deserve a second chance, let’s build a great building for them behind the governor’s mansion.” The now habitual release by the members of the Governor Cuomo appointed New York State Parole Board is just another callous example of the utter disregard many of our current politicians have for the ultimate sacrifice made by too many of our brothers and sisters. We need to fight through the ballot box to return politicians to office who appreciate law enforcement.

THE NYC COUNCIL IGNORES SURGE IN VIOLENT CRIME YET CONTINUES PERSECUTION OF NYPDGovernor Cuomo mandated all municipalities in New York State to formally submit plans to codify police reforms by April 1st or potentially lose state aide. The City Council has come out with the following 12 proposals to satisfy their progressive agenda and the Governor’s focused mandate against law enforcement.

 

  1. Remove the Police Commissioner’s final disciplinary authority:  Sponsored by Majority Leader Laurie Cumbo and Council Member Stephen Levin, this resolution would call on the State to enact legislation that would remove the New York City Police Commissioner’s exclusive authority over police discipline, allowing the CCRB to impose discipline in cases involving use of force, abuse of authority, discourtesy, and offensive language. 
  2. Ending qualified immunity for police officers: Sponsored by Council Member Stephen Levin, this bill would end qualified immunity for police officers in New York City. The bill would create a new local civil right protecting New Yorkers against unreasonable searches and seizures, including the use of excessive force. The private right of action associated with that right would prohibit qualified immunity as a defense.
  3. Requiring confirmation of the Police Commissioner: Sponsored by Council Members Adrienne Adams, Ben Kallos, Public Advocate Jumaane D. Williams, and Speaker Corey Johnson this bill would subject the Police Commissioner to the advice and consent of the Council.
  4. Investigating police officers with a history of bias: Sponsored by Council Member Vanessa L. Gibson, this bill would allow a greater level of scrutiny of past activity by NYPD employees found to have exhibited bias, prejudice, intolerance or bigotry. The bill would require the City Commission on Human Rights (CCHR) to investigate that employee’s work history to determine if it was influenced by bias or prejudice. The CCHR would then turn over its findings and recommendations to the NYPD for potential further action, including any discipline, as well as to District Attorneys.
  5. Reporting on vehicle stops: Int. 1671sponsored by Council Member Adrienne Adams, would require the NYPD to issue a quarterly report on all traffic stops and vehicles stopped at roadblocks or checkpoints.
  6. Preserving freedom of the press: Int. 2118, sponsored by Council Member Keith Powers, would give the Department of Citywide Administrative Services (DCAS) sole authority to issue, suspend and revoke press credentials. DCAS would be required to establish rules setting forth the procedures and criteria for applications for press credential and suspension and revocation of press credentials, including procedures for appealing a suspension, revocation or denial of application.
  7. Creating a non-police emergency response for mental health emergencies: Sponsored by Council Members Diana Ayala, Speaker Corey Johnson, Public Advocate Jumaane D. Williams, Alicka Ampry-Samuel, Robert Cornegy, Helen Rosenthal, Adrienne Adams, Farah Louis, and Majority Leader Laurie Cumbo, this bill would create an Office of Community Mental Health within the Department of Health and Mental Hygiene to develop a Citywide Mental Health Emergency Response Protocol, wherein mental health emergencies are responded to by a Mental Health Emergency Response Unit, rather than the police. The Office would train relevant City employees regarding the protocol, including the NYPD officers, 911 call operators, and new academy recruits.
  8. Reforming the role of school safety agents: Sponsored by Council Members Costa Constantinides, Helen Rosenthal, Mark Treyger, Adrienne Adams, and Speaker Corey Johnson, this bill will ensure that NYPD will be fully removed from school safety after June 2022. The bill will require significant reforms to the program and the role of school safety agents by August 2021, so that agents no longer make arrests, carry weapons or mechanical restraints, or wear law enforcement uniforms. School safety personnel would also be retrained, with a focus on areas such as restorative justice, child and youth development, and de-escalation.
  9. Protecting students in emotional crisis: Int. 2188sponsored by Council Member Diana Ayala, would regulate the NYPD’s response to children in emotional crisis within public schools. The bill establishes procedures responding to children in emotional crisis and limits the use of mechanical restraints on children in emotional crisis. Additionally, school safety personnel would be required to receive training on identifying and responding to children in emotional crisis.
  10. Increasing transparency on school safety agent turnovers: Sponsored by Council Member Mark Treyger, this bill would require reporting on the employment turnover of school safety agents, including information on transfers, terminations, and resignations.
  11. Giving principals a larger role in the school safety program: Sponsored by Council Member Mark Treyger, this bill would requiring reporting on the input principals have provided on the performance of school safety agents assigned to their school.
  12. Moving traffic crash investigations to the Department of Transportation: Sponsored by Council Members Ydanis Rodriguez, Brad Lander, Speaker Corey Johnson, and Stephen Levin, this bill would transfer the primary responsibility for investigating serious vehicular crashes from the police department to the Department of Transportation (DOT). The bill would require the DOT to create a crash investigation and analysis unit tasked with investigating all vehicle crashes involving significant injury.

Dear Brothers and Sisters:

 

I hope you and your families are all well and that you enjoyed a blessed and peaceful holiday

season. By now many of you have received your 2021 credentials and may have noticed that this year’s Lodge Card reflects that Rich Clifford is the New President of our Lodge. 

 

My third term as your Lodge President would normally have expired in November 2020. As 

previously explained and due to the pandemic, extraordinary measures were enacted extending the term of the current Executive Board through 2022. However, it was my intention that at the expiration of my third term this past November, I would not seek re-election. Six years in a leadership position of any organization is a long time and I felt it timely to step aside.

 

Our team has worked tirelessly towards the mission of our lodge and its membership. We have 

built a solid foundation of dedicated and experienced leadership ensuring a strong future for our lodge. The knowledge that our lodge has a great Executive Board in place helped me in my decision to make room for that future leadership team to move us forward. 

 

As we begin our 38th year we can look back and be proud of the accomplishments of the

various administrations of our Lodge. Our longevity is a result of the integrity of both the leadership and you the membership, of our lodge. That is why we will continue to grow. Our Lodge will continue to serve the Law Enforcement community as well as the citizens we all swore to protect.

 

We honor our fallen. We recognize our brothers and sisters for their bravery and dedication. 

We support our community. We support each other, for no other will. It’s what we do. Know that wherever you go you will be known to be a member of a great FOP Lodge. We are Memorial Lodge 100. 

 

For this, it has been my honor, and greatest privilege, that for the past six years I was chosen by 

you as the steward of this great Lodge. Your support has enabled the Lodge to serve you, our fallen brothers and sisters, their families and all who support the Law Enforcement Community. Dear Brothers and Sisters:

 

For the past six (6) years, Memorial Lodge 100, has benefited from the leadership of a tireless professional and true gentleman – Rick Bermudez.  For those that do not personally know Rick, I describe him as a Cop’s Cop and someone you would want next to you in a Radio Car.  I consider myself a better person for being lucky enough to have known and learned from Rick for the past 36 years; I first met Rick in 1984.

 

It is both my honor and my privilege to be the new President of Your Lodge – Memorial Lodge 100.  Lodge 100 is one of the largest FOP Lodges in New York State.  Administering the Lodge is a team effort which entails and relies upon a great deal of volunteered time and a firm dedication to fostering and maintaining an ideal.  The team, your Board, can be found on the back of your 2021 Lodge 100 courtesy card.  Each one of these Brothers & Sisters devotes time and energy to ensure that the Lodge grows and progresses forward, and that we are true to our mission of “Never Forgetting the Fallen”.   All these Board members have my sincere thanks for their dedication and efforts.

           Memorial Lodge 100 is unique in our membership; we honor all law enforcement and welcome members from all agencies in our ranks.  We boast members from local, state, and federal agencies, residing in almost all 50 states.  You, as a Member, are encouraged to bring in a new member, and out of state members are welcome.  Memorial Lodge 100 is your Lodge, with your help and participation we can make it grow stronger.  Lodge 100 always welcomes your feedback and constructive criticism. 

 

Now, more than ever, we must stand together with our common bond within our law enforcement community.  As many of you have witnessed, numerous local, state, and federal politicians have fomented a culture of contempt for law enforcement.  Many political candidates petition the FOP for endorsements, and as Rick Bermudez and I both hold office in the New York State FOP Board, be assured that we will only vote to support those candidates that show and express support for law enforcement. 

 

Rick Bermudez made Lodge 100 great again.  My goal is to build on the solid foundation that Rick left and to keep Lodge 100 great.  

 

As always, remember our brothers and sisters protecting our streets at home and those serving in the armed services.  Pray for the recovery of those who are suffering illness and “Never Forget the Fallen” or their surviving families.

2021 RENEWAL SEASON IS STILL GOING ON: 

1) 2021 Renewal Form is attached.

2) If possible, fill out the form on your computer and print, sign, enclose your dues payment and send. If you have any changes from 2020 please check the box in the upper right corner.

3) Please do not send in a renewal that says, same as last year. A current completed application is required for your insurance qualifications.

4) Your renewal application will not be processed without your dues enclosed.

5) It is 2021, 99% of adults have email, Newsletters have been sent via email. Only 2 Newsletters per year go out hard copy via the US Mail. This is a cost savings for the Lodge and reduces the labor-intensive mailing process performed by the VOLUNTEERS, to complete these administrative tasks. Please provide your email address on your renewal application.

COVID RELATED CANCELLATION OF ANNUAL DINNER:  In conferral with, and with the agreement of, the Executive Board of Lodge 100 it has been decided that due to the uncertainty associated with the Covid-19 pandemic it has become apparent that we cannot confidently schedule routine annual events. Therefore, it has been agreed upon that we will not be hosting the annual dinner traditionally held in April. The dinner, barring any unforeseen circumstances, will be held in April 2022.

Active Members living outside of New York State who wish to receive FOP License plates ARE NOT REQUIRED TO JOIN ANOTHER LODGE to do so. The New York State FOP has a reciprocal agreement with most States to provide certain benefits to NYS FOP members in good standing. You may apply for FOP License Plates in the State you live without having to join the local FOP.

In the past, we had been informed by some of our members that they were being pressured to join the local FOP lodge to receive FOP benefits. If you are being pressured to join another lodge to afford yourself FOP benefits, that you have earned, immediately contact Lodge 100. A FOP Lodge 100 Board member will intercede to remedy the matter.

FOP MOBILE APP:  As published in the June 2020 edition of the FOP Journal, the National FOP announced the launch of an FOP free Mobile App for all FOP brothers and sisters across the nation.  It became available on May 18, 2020.  To download the app, search NFOP in the Apple App Store (for iPhone) or Google Play (for Android), download the app and then register.  Once your membership is confirmed, your app registration will be approved, and you will receive a confirmation email.  Once approved, you can log in and have access to all the wonderful features and information in the app.  Please make sure to allow push notifications from the app on your phone, this way, you will receive an immediate message to your lock screen or banner at the top when breaking FOP news happens. It is also encouraged to add a profile photo to your account by clicking “more” then “settings” then “account details” to set your personal photo.  

 

     There is no shortage of features on this app – and all are designed to improve communication and get you information quickly on all things happening within the Order.  There is a newsfeed, just like Facebook and Twitter, and you can scroll through videos, notifications, resources, and information the National sends out.  There are links and banner ads that you can click on that will take you directly to our one-of-a-kind COVID-19 website, the National current website, and their merchandise partners.  

 

     There is a messaging feature on the app (much like Facebook Messenger) that allows you to send text messages within the app to other members in the country who have downloaded it.  There is an events tab loaded and continuously updated with all upcoming FOP conferences, meetings, summits, trainings, etc., so that you can plan ahead.  The resource folders, located under the “more” button, are bursting with information.  You will be able to find legislative and labor updates, past issues of the Journal, COVID-19 resources, Aetna Medicare Advantage plan information, FOP Newsroom and much more. 


 

NEW YORK STATE COVID-19 VACCINES:  New York State has begun distributing the COVID-19 vaccine in phases based on need and risk. The following is some basic information pertaining to who is currently eligible to receive the vaccine. Eligible New Yorkers in Phase 1a and 1b are:

  • High-risk hospital workers (emergency room workers, ICU staff and Pulmonary Department staff)

  • Residents and staff at nursing homes and other congregate care facilities

  • Federally Qualified Health Center employees

  • EMS workers

  • Coroners, medical examiners and certain funeral workers

  • Staff and residents at OPWDD, OMH and OASAS facilities

  • Urgent Care providers

  • Individuals administering COVID-19 vaccines, including local health department staff

  • All Outpatient/Ambulatory front-line, high-risk health care workers of any age who provide direct in-person patient care

Step 1: Determine eligibility and schedule an appointment. First, you should complete the Am I Eligible? App to check their eligibility and find vaccination locations near you where you can schedule an appointment, or call the New York State COVID-19 Vaccination Hotline. Note that due to limited supply from the federal government, it may be 12 or more weeks before an appointment is available to you.  

Step 2: Complete the Vaccine Form. Once and only once you have a confirmed appointment, you must complete the New York State COVID-19 Vaccine Form. This form can be completed online and you will receive a submission ID, or can be completed at your vaccination site. (We encourage New Yorkers to complete the form ahead of time.)

Step 3: Bring proof of eligibility to your appointment. When you go to your vaccination site for your appointment, you must bring proof of eligibility. This may include an employee ID card, a letter from an employer or affiliated organization, or a pay stub, depending on the specific priority status. If you are eligible due to age, you should bring a form of ID (like a Driver's License or passport) that includes your date of birth.


 

MEDICARE PREMIUMS AND DEDUCTIBLES:  

Medicare Part B: The standard monthly premium for Medicare Part B enrollees for 2021 will be $148.50; an increase of $3.90 from $144.60 in 2020.

The annual deductible for all Medicare Part B beneficiaries in 2021 will be $203; an increase of $5 from the annual deductible of $198 in 2020.

LEGISLATIVE ASSAULT AGAINST LAW ENFORCEMENT CONTINUES IN ALBANY:  

As if Bail Reform and other recent anti law enforcement legislation (Repeal of Civil Rights

Law 50-a) coming out of the Albany Legislature hasn’t hampered the ability of state law enforcement to safely and effectively perform their duties, additional delusional and dangerous legislation continues to be introduced by detached state law makers. Some state legislators do not believe they have sufficiently hampered the ability of police officers to effectively perform their sworn duties and prevent citizens from being victimized by opportunistic criminals. They continue to propose legislation specifically targeted at criminalizing the police and providing more freedoms and protections to criminals.

 

     These are the names and pieces of legislation recently introduced in Albany to further weaken police officers and empower the criminal:

 

     On January 11th, State Assemblyman Robert Carroll (D-Park Slope) introduced legislation (A1914), co-sponsored by Rebecca Seawright (D-Upper East Side) and Nathalia Fernandez (D-Bronx: Pelham Gardens/Morris Park), which will require the termination of any police officer or peace officer who uses physical force which is not justifiable or which is not part of procedure regardless of if harm is done [to] any person or if any complaint is filed against the police officer or peace officer.

     On January 6th, State Senator Alessandra Biaggi (D/WF-Upper Bronx) introduced Senate Bill S1064, co-sponsored by Senators Robert Jackson (D/WF-Upper West Side Manhattan), Jessica Ramos (D/WF-Jackson Heights), and Gustavo Rivera (D/WF- Fordham/Tremont Bronx) which relates to requiring police officers to maintain liability insurance. In summary the bill states that it, “amends the General Municipal Law by adding a new section 52-a to require all police officers obtain liability insurance and maintain coverage during the course of their employment as a police officer. Their employer must cover the base rate of the policy.

Senator Biaggi has also introduced Bill S839; An act to amend the executive law, in relation

to prohibiting the use of unmarked police vehicles, concealed identify police vehicles and under-

cover police officers for routine traffic enforcement. The act prohibits unmarked police vehicles or officers from giving traffic violations. And, she introduced Bill S809; Prohibit use of chemical incapacitants. 1. No law enforcement agency shall use any chemical incapacitant, except for pepper spray. Pepper spray shall be limited to liquid spray canisters of a volume no greater than 0.75 ounces, and shall not be used for crowd control purposes.
